Someone stole my identification, then used it to withdraw funds from my deposit account. The bank closed my account. Can it do that?
Generally, it is legal for a bank to close an account for fraudulent activity as explained in your deposit account agreement. In cases of identity fraud, the account closure action may be taken to prevent more fraudulent withdrawals.
Review your account agreement for policies specific to your bank and your account and contact the bank directly for more information.
If you believe your bank wrongfully closed your account, file a written complaint with the bank’s regulator. If your bank is a national bank or federal savings association, file a written complaint with the Office of the Comptroller of the Currency (OCC) by contacting the OCC’s Customer Assistance Group.
